Aftly

Terms of Use

Version 1.2, 5 October 2026

1. Parties and subject matter

These terms form an agreement between Emir Khakimovich Vakhitov (the "Rightsholder") and the individual using the Aftly mobile application (the "User", "you").

They set out the conditions for using Aftly (the "App"), software intended for independently tracking your state and behaviour after the end of a romantic relationship.

The licence for the App obtained through the App Store is governed by Apple’s Standard EULA: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These terms supplement it for use of the App’s features and do not limit mandatory consumer rights. The Standard EULA prevails in a conflict about the licence.

2. Acceptance

Tapping Start on the first screen of the App constitutes full and unconditional acceptance of these terms and of the Privacy Policy in their current version.

If you do not agree with any provision, stop using the App and remove it from your device.

The date of acceptance and the version number are stored locally on your device and are not transmitted anywhere.

3. Age restriction

The App is intended for individuals aged 18 and over. Its content addresses emotional states and refers to mental-health risks.

By starting to use the App you confirm that you have reached this age.

4. Nature of the App

The App is a self-help and informational tool. It is not a medical device and is not a means of diagnosing, treating or preventing any condition.

The App does not provide medical, psychotherapeutic, psychiatric or any other licensed services and does not replace consultation with a doctor, clinical psychologist or psychotherapist.

The scales and questionnaires used in the App were written for the App itself and are not validated clinical instruments. Their output is not a diagnosis and must not be used to make medical decisions.

Materials in the Articles section are informational. Links to third-party research are provided so that sources can be checked and do not imply any association between the Rightsholder and their authors or publishers.

5. Seeking help

If your state worsens, persists over a long period, or you have thoughts of harming yourself, contact a doctor or emergency services immediately. In the Russian Federation the single emergency number is 112; in the EU and many other countries it is 112; in the United States, 988 or 911.

The App may display a reminder about this, but it does not monitor your state in real time, does not notify third parties and cannot call for help on your behalf.

6. Rights in the App

Exclusive rights to the App, its source code, interface, texts, design and other elements belong to the Rightsholder.

Rights and restrictions concerning use of the App are determined by the Standard EULA and applicable law.

Entries you create in the App belong to you. The Rightsholder acquires no rights in them and has no access to them.

7. No warranties

The App is provided "as is". The Rightsholder does not warrant any particular outcome, improvement in your state, or recovery within any period of time.

The Rightsholder does not warrant uninterrupted or error-free operation, nor compatibility with every device and operating-system version.

8. Liability

You make your own decisions about your actions and bear responsibility for their consequences.

To the extent permitted by applicable law, the Rightsholder is not liable for lost profit, non-pecuniary harm or other losses arising from use of or inability to use the App.

The Rightsholder is not liable for loss of your data caused by deleting the App, device failure, loss of the device, a forgotten passcode, or use of the erase-everything function.

9. Changes and termination

The Rightsholder may amend these terms. A new version carries a new version number and date and is available in the updated App’s settings.

You may stop using the App at any time by deleting it from your device. This removes files from the App’s directory, but not earlier backups or exports. To clear Keychain items, use the erase function in settings before deleting the App.

10. Governing law

These terms are governed by the law of the Russian Federation.

Disputes are to be resolved through negotiation and, failing agreement, in the court at the Rightsholder's place of residence, unless consumer-protection law provides otherwise.
